COUNCIL BLUFFS DIVORCE ATTORNEY

Iowa Child Custody and Child Support Attorney

Your children are not property and they are certainly not bargaining chips in your divorce. Do not let your spouse interfere with your relationship with your children as you go through divorce. Whether it is denial of visitation and support or disparagement of one parent by the other, it is up to you to take legal action and protect your rights. I am Council Bluffs divorce lawyer David A. Poore and I am ready to help you through your divorce.

When it comes to child custody and support in Iowa, the courts look out for the best interests of the children. The court will also consider several other factors, such as the spouses’ relationship prior to divorce. Both parents are presumed to be appropriate custodians of the children and the courts believe children benefit from a healthy relationship with each parent.

With the court’s standards in mind, there are still several custody options available. Joint legal custody makes both parents equal when it comes to legal decisions, while day-to-day decisions are handled by the custodial parent. The courts tend to lean toward shared physical custody, but if one parent is unfit, courts can award primary physical custody as well.

Whatever challenges you may face, do not let your spouse define your relationship with your children. Fight to preserve your parental rights, so you can maintain a meaningful relationship with your children.

Property Division

Iowa is an equitable distribution state and will not necessarily divide property equally between parties. The courts recognize a difference between marital property and separate property, such as gifts, inheritances and premarital property. I work with forensic accountants and other experts to get a better understanding of the value of property in a marriage. I will also properly consider retirement rights, which are considered part of a marital estate.
